General Terms and Conditions of Sale

These Terms of Use (“Terms”) govern access to and use of the Eloresto website (eloresto.com) and the concierge and magazine services (“Services”) provided by Novalane Operations LLC. By accessing or using the Site or the Services, you agree to these Terms. If you do not agree, you must stop using the Site and the Services.

1. Introduction

These Terms of Use govern access to and use of the website Eloresto.com (the “Site”) and the concierge and magazine services (“Services”) provided by Novalane Operations LLC, a Wyoming limited liability company, located at 2106 House Avenue, Suite 278, Cheyenne, WY 82001, USA.

By accessing or using the Site or Services, the user (“You”) acknowledges having read, understood, and agreed to these Terms.

2. Description of the Service

Eloresto is primarily an online restaurant reservation platform. Through the Site, users can:

  • Search for restaurants by location, name, or cuisine type
  • Check real-time availability and book a table
  • Receive booking confirmations and reminders

Eloresto acts solely as an intermediary and does not provide the final service (transport, restaurant, activities, etc.). All bookings are made on behalf of the customer, and the final service is delivered by independent third-party providers.

Eloresto is not responsible for delays, cancellations, pricing variations, incidents, or the execution of services provided by third-party providers.

In addition to concierge assistance, Eloresto offers a separate weekly digital magazine subscription that provides subscribers with editorial travel inspiration and recommendations content (“Magazine Subscription”). The Magazine Subscription is a digital content product and does not include concierge assistance hours.

3. Account Creation and User Obligations

To access the Services, users may be required to create an account and provide accurate and up-to-date information. Users are responsible for maintaining the confidentiality of their login credentials and for all activity occurring under their account.

Users agree not to:

  • Use the Services for illegal purposes
  • Impersonate any person
  • Use the Service to circumvent providers’ own booking rules
  • Engage in abusive or fraudulent use of the platform

Eloresto reserves the right to suspend or terminate access in case of breach of these Terms.

4. Subscription Plans and Pricing

Pay-per-booking (base service):

  • A service fee of $3 is charged per confirmed restaurant reservation.
  • No subscription or commitment is required.
  • The fee is charged at the time of booking confirmation.

Unlimited Booking Assistant (optional monthly subscription):

  • $69.99 per month.
  • Unlimited booking assistance for restaurants and all other lifestyle and travel-related service categories (transportation, leisure, events, etc.).
  • Billed monthly. Renews automatically unless canceled before the renewal date.
  • Subscribers are not charged the $3 per-booking fee — all bookings are included in the monthly plan.

Eloresto reserves the right to revise prices with prior notice to existing customers. Promotional prices are temporary, apply only for the conditions stated at the time of purchase, and revert to the standard price thereafter.

Magazine Subscription :

A subscription to the digital magazine is available for a maximum of $7.60 per month.

Billing begins seven (7) days after the subscription date. At the end of this period, the subscription is automatically renewed unless the Customer cancels it beforehand. The frequency of payments may vary, in accordance with the payment schedule agreed upon at the time of subscription.

The subscription is entered into for an indefinite period and may be cancelled at any time.

This subscription is separate from the Concierge subscription. It may be taken out separately or in conjunction with the Concierge subscription, and its cancellation does not automatically affect the other subscription, unless otherwise specified at the time of subscription.

Eloresto reserves the right to change its rates at any time. The Customer will be notified in advance of any changes.

5. Payments and Execution of Service

By completing a booking, users authorize Eloresto to process the applicable service fee through secure third-party payment partners. All charges become final once processed unless otherwise stated in Eloresto’s commercial guarantee.

By activating the Unlimited Booking Assistant subscription, the user expressly requests immediate execution of the service and authorizes Eloresto to charge the applicable monthly fee on a recurring basis until cancellation.

By validating the Magazine Subscription, the user expressly requests immediate access to the digital content, where available, and acknowledges that delivery may begin immediately.

The merchant reserves the right to offer promotional pricing on any product or subscription available on its website at its sole discretion. Promotional prices are temporary, apply only for the duration and conditions explicitly stated at the time of purchase, and automatically revert to the standard regular price thereafter. Such promotions do not constitute a permanent modification of the standard pricing listed in these Terms.

6. Cancellation Policy and Commercial Guarantee

The $3 booking fee is non-refundable once a booking has been confirmed, except as provided in the commercial guarantee below. Users may cancel any subscription at any time via:

  • Live chat (recommended – instant cancellation)
  • The contact form
  • The “Manage my subscription” page
  • Email contact@eloresto.com

Cancellation of one subscription does not automatically cancel the other.

Eloresto offers a commercial guarantee: users may request a refund of their last period of subscription in case of dissatisfaction. This guarantee is discretionary, does not constitute a legal right, applies once per customer, and does not apply to the per-booking fee or third-party service fees.

7. Support and Availability

Eloresto offers priority support via chat from 9:00 am to 7:00 pm, 7 days a week.

8. Role of Eloresto – Limitation of Liability

Eloresto provides booking facilitation only. Eloresto does not cook or serve food, does not operate restaurants, taxis, or activities, and does not guarantee availability, price stability, or performance of third-party services.

Eloresto is not liable for:

With respect to the Magazine Subscription, Eloresto provides digital editorial content on an “as is” and “as available” basis and does not guarantee uninterrupted availability of the Site or delivery mechanisms. Eloresto is not liable for indirect, incidental, or consequential damages related to access to the Magazine Subscription, to the fullest extent permitted by law.

9. Intellectual Property

All site content, including text, logos, branding, and service methods, is the exclusive property of Novalane Operations LLC. Any reproduction, distribution, modification, or extraction is prohibited without written authorization.

10. Account Retention and Deletion

Eloresto retains user account information only as necessary for:

  • Subscription management
  • Legal compliance
  • Fraud prevention
  • Service history

Users may request deletion of their account at any time via email. Deletion is permanent and irreversible. Subscription cancellation must be processed prior to account deletion.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law.

Any dispute shall first be addressed through good-faith negotiation. If no resolution is reached, the dispute shall be submitted to binding arbitration in the United States, unless prohibited by mandatory consumer-protection laws applicable to the user.
