This Legal Notice governs access to and use of the website available at eloresto.com (the “Site”), published and operated by Novalane Operations LLC.

Novalane Operations LLC is responsible for the editorial content published on the Site, subject to the limitations of liability described below and in the Terms of Service.

2. Hosting

The Site is hosted by SiteGround Hosting Ltd.

Servers used to operate the Site may be located in the United States and/or the European Union for redundancy, performance, and security purposes. The hosting provider implements industry-standard technical and organizational measures to help protect the availability and integrity of the Site.

3. Description of the Service

Eloresto is an online restaurant reservation platform. Through the Site, users can search for restaurants, check availability, and complete restaurant bookings. A service fee of $3 applies to each confirmed booking.

In addition to the pay-per-booking service, users may optionally subscribe to the Eloresto Unlimited Booking Assistant plan ($69.99/month), which provides unlimited booking assistance for restaurant reservations and all other lifestyle and travel-related services (transportation, leisure activities, and similar everyday convenience tasks). Users may also optionally subscribe to the Eloresto digital magazine.

Eloresto acts solely as an intermediary and facilitator. The actual services (transportation, dining, activities, accommodation, etc.) are ultimately provided by independent third‑party providers selected by or on behalf of the user. Eloresto is not a transportation company, hotel, restaurant, travel agency, medical provider, or regulated professional.

The detailed conditions governing subscriptions, billing, cancellations, and the scope of the concierge services are set out in the Terms of Service available on the Site.

4. Access to the Site

Eloresto endeavours to keep the Site accessible and functional on a continuous basis.

However, access to the Site may be temporarily suspended or limited without prior notice, including but not limited to:

  • maintenance or updates,
  • technical incidents or outages,
  • security measures or risk mitigation,
  • events beyond the reasonable control of Novalane Operations LLC.

Novalane Operations LLC shall not be liable for any unavailability, interruption, or malfunction of the Site, nor for any resulting loss or inconvenience.

Access to some parts of the Site may require the creation of a user account and the acceptance of the Terms of Service.

5. Intermediary Status and Third‑Party Services

Eloresto’s role is limited to assisting users in identifying, contacting, and booking third‑party providers.

The performance of the underlying services (such as taxi rides, restaurant meals, leisure activities, etc.) is entirely the responsibility of those third parties.

Accordingly:

  • Eloresto does not guarantee the availability, quality, safety, legality, or suitability of third‑party services.
  • Eloresto is not a party to the contract concluded between the user and any third‑party provider.
  • Any complaint relating to the execution of the third‑party service (delay, cancellation, behaviour, quality, safety, etc.) must be addressed directly to the provider concerned, without prejudice to any assistance that Eloresto may offer on a goodwill basis.

Users remain solely responsible for verifying that the services they request are suited to their needs and for complying with any terms, conditions, or policies imposed by third‑party providers.

6. User Responsibilities and Acceptable Use

By accessing and using the Site, users agree in particular to:

  • provide accurate, complete, and up‑to‑date information when creating an account or submitting a request,
  • keep login credentials confidential and not share their account with third parties,
  • use the Site in a lawful manner and only for personal, non‑commercial purposes,
  • refrain from any fraudulent, abusive, or misleading use of the concierge service,
  • not attempt to damage, disrupt, or interfere with the proper functioning or security of the Site (including by introducing malware, scraping, or attempting unauthorized access).

Eloresto reserves the right to suspend or terminate access to the Site or to the concierge service in the event of a breach of applicable laws or of the Terms of Service.

7. Intellectual Property

Unless otherwise stated, all content available on the Site—including, without limitation, texts, logos, trademarks, graphics, icons, images, interface elements, and underlying software—is either owned by or licensed to Novalane Operations LLC and is protected by applicable U.S. and international intellectual property laws.

Users are granted a limited, non‑exclusive, non‑transferable, revocable license to access and use the Site for personal purposes, subject to compliance with this Legal Notice and the Terms of Service.

Any reproduction, adaptation, modification, distribution, or exploitation of all or part of the Site’s content, by any means and for any purpose other than personal use, without prior written authorization from Novalane Operations LLC, is strictly prohibited and may result in civil and/or criminal liability.

8. Personal Data and Privacy

In the course of operating the Site and providing concierge services, Novalane Operations LLC may collect and process certain personal information about users (e.g., contact details, request details, payment-related information via third‑party payment processors, usage data).

The purposes and conditions of such processing, as well as users’ choices and rights regarding their personal information, are described in detail in the Privacy Policy available on the Site.

Users are invited to read the Privacy Policy carefully; by using the Site, they acknowledge that they have been informed of how their personal information may be handled.

9. Cookies and Similar Technologies

The Site may use cookies and similar tracking technologies (such as pixels or local storage) for technical, analytics, and user experience optimization purposes (e.g., session management, usage statistics, interface preferences).

The types of cookies used, their purposes, and the options available to users (e.g., browser settings) are described in the Privacy Policy or in a dedicated cookie section, as applicable.

10. Limitation of Liability

To the fullest extent permitted under applicable law:

  • Novalane Operations LLC makes no representation or warranty that the Site or any content will be error‑free, uninterrupted, or free from vulnerabilities or harmful components.
  • The Site and the concierge service are provided on an “as is” and “as available” basis, without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non‑infringement.
  • Novalane Operations LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for loss of profit, revenue, data, or business opportunities, arising out of or in connection with the use of the Site or reliance on its content.

In all cases, any liability of Novalane Operations LLC that cannot be excluded under applicable law shall be limited as described in the Terms of Service, which govern the contractual relationship between Eloresto and its subscribers.

11. Changes to the Site and to this Legal Notice

Novalane Operations LLC may update, modify, or supplement the content of the Site, this Legal Notice, the Terms of Service, and the Privacy Policy at any time, in order to reflect changes in the service, legal requirements, or internal practices.

The version published on the Site at the time of access is the one currently in force.

Users are encouraged to review this Legal Notice regularly. Continued use of the Site after any change constitutes acceptance of the updated Legal Notice.

12. Governing Law

This Legal Notice, as well as any non‑contractual obligations arising from or related to access to the Site, shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict‑of‑law rules.

The contractual relationship between Eloresto and its users, and the rules governing dispute resolution (including any arbitration agreement and waiver of class actions), are set out in the Terms of Service available on the Site.
